Patented Plants

Patented plant varieties are an excellent source of new, exciting, never-before-seen plants.

Patents are granted when a plant is uniquely different or superior to all of the existing plants within a species. These plants may have unique foliage and flower colors, longer blooming periods, higher fruit yields, easier harvesting, improved pest and disease resistance, or many other characteristics that distinctly them apart from any similar plants.

The Plant Patent Act was passed by the U.S. Congress in 1930. This action granted anyone who discovered or hybridized a new plant the exclusive right to determine who would propagate and sell it. Plant patents prohibit anyone from asexually reproducing a patented plant for a period of 20 years from the time the patent is applied for. (Asexually reproduced plants are those produced from cuttings, division, or cloning of the original plant.)

This protection allows the discoverer of a plant an opportunity to benefit from the sale of the new variety before anyone else can. It also serves as incentive for plant researchers to keep looking for better plants. Many thousands of plant patents have been issued through the years resulting in a wealth of unique, beautiful, and exceptionally durable plant choices for home gardeners and landscapers.

The following plants are U.S. patent protected varieties. Unauthorized propagation of these varieties is prohibited.
